Edvantage “Virtual Holiday Partner Fair” (VHPF) Contest Rules and Regulations

Enter for a chance to win one of over twenty-five (25) prizes from Edvantage brand partners' or the grand prize (1) of CAD 1,000 in value, when you attend the Edvantage VHPF.

Prizes
Over twenty-five (25) Edvantage brand partner prizes’ including e-gift cards, physical gift cards, and products (“ e-gift Prizes”) are available to be won through Edvantage and its partners during the VPHF. Plus two $50 CAD Dining Card giveaways when two event attendees follow our Instagram page @edvantageperks during the event contest period. The grand prize winner can choose their gift card(s) from the selection of partners (up to a maximum of three) offered through the Edvantage Program for a total of CAD 1,000.

Contest Period
The Virtual Holiday Partner Fair Contest (the “Contest”) begins at 3:01 p.m. EST on November 22, 2023, and closes at 5:59:59 p.m. the same day (“Contest Period”). Please read these full Contest rules and regulations below.

Contest Eligibility
This Contest is open to all active and registered Edvantage members in Ontario. Attendees must be at least 18 years of age at the time they enter this Contest. employees, directors, trustees, and officers of OTIP and its affiliated companies¹, (collectively for purposes of this Contest, “OTIP”), the prize selection team and members of their respective immediate families and/or anyone with whom the employees, directors, trustees, or officers of OTIP are domiciled, are excluded.

To enter and be eligible to win any of the prizes, attendees must be active, registered Edvantage members who receive an exclusive invitation and link to RSVP. They must RSVP YES providing their first and last name, and valid email address, and attend the event when their name is called. Failure to complete the mandatory information or process described means the attendee’s name will either not be entered or if drawn will be disqualified and another name drawn.

Attendees have 20 chances to win 20 Contest giveaways PLUS the grand prize as long as they are eligible and present at the event when their name is drawn.

RSVPs must be received on or before 11:59:59 p.m. EST on Tuesday, November 21, 2023. An authorized account holder is deemed as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses or the domain associated with the submitted email address.

Winner Selections / Draws
Over twenty-five (25+) separate and random draws will be made, each draw is for an Edvantage brand partner Prize e-gift throughout the Contest Period from all eligible attendees submitted into the Contest through the Edvantage RSVP list. Plus, two event attendees who also follow @edvantageperks, will also be randomly drawn during the event contest period, to win one of two $50 CAN Dining Gift Cards. Each separate and random draw will take place in Waterloo, Ontario on Wednesday, November 22, 2023, by an independent selection team.

The odds of winning depend on the number of eligible attendees present at the event when a draw occurs. All decisions by the independent prize selection team are final and binding on the participants in all matters relating to the Contest.

To win a Prize the selected attendee must first correctly answer without assistance of any kind, a time-limited, mathematical, skill-testing question in writing before being declared a Prize winner.

For these rules, the attendee is the person whose name RSVP’d to the event, added to the guest list, and attended to be eligible for the Contest giveaways.

The selected attendee will be notified in the chat during the event and by email using the email address entered into the Contest. If the selected attendee cannot be contacted or does not respond after a minimum of three attempts within seven calendar days from the first attempt at contact if a Prize notification notice is returned as undeliverable, or if the attendee incorrectly answers the skill-testing question, declines the Prize or fails to return a release of liability within 10 days to OTIP/Edvantage, that attendee will be declared ineligible to win the prize and another attendee will be selected in the manner described above.

When an attendee is contacted as the selected winner for a Prize, he or she will be emailed the skill-testing question, a declaration of compliance with Contest rules, and a liability and publicity release can be sent.

When a selected attendee has been deemed/declared the winner, the winner will receive an email from Edvantage with their Prize details (email includes redemption instructions).
The winner of the grand prize of the e-gift cards valued at CAD 1,000 can select up to three Edvantage partners for their preferred combination of total e-gift card(s) they would like to receive. The winner can allocate their $1,000 balance to as many e-gift Card options as they would like for a combined total of $1,000, or they can use the full balance of $1,000 for one Edvantage brand partner e-gift Card. For example, $250 can be applied to a Columbia Sportswear gift card, $250 to a GoodLife gift card, and $500 to a VIA Rail gift card. The winner will receive their e-gift Card(s) by email from Edvantage with redemption instructions. Subject to any changes by Edvantage, the e-gift Card options and Prizes are in CAD currency and from the following companies (subject to change without notice):

E-gift Cards will be delivered electronically to the eligible winner by email from Edvantage. Members must provide a valid email address to receive their Prize. E-gift cards will only be delivered electronically and not by any other means of delivery. Please allow ten (10-20) business days for delivery of the e-gift card(s) and Prizes. All gift cards (electronic and physical) can only be used in Canada.

E-gift cards and physical gift cards fall under the rules and regulations, terms, and conditions of each company issuing the e-gift card, as amended from time to time. OTIP, Edvantage, or the companies issuing the e-gift cards will not be responsible for any lost, stolen, or misplaced gift cards or gift cards that have expired with a balance remaining on them after they have been delivered to the winner, or any fees or charges associated with e-gift cards in any way. Gift cards will not be replaced, refunded, or reimbursed if lost, stolen, or misplaced. Purchase amounts that exceed the value of e-gift cards will require payment by the user by some other method for the balance due.

Personal information will not be shared with parties outside of this promotion but will be used by Edvantage to deliver the gift card of choice or product prize by way of either website email to the qualified winner or post mail to their home address. The companies represented at the event, are participating sponsors of the rewards, and are affiliated with OTIP’s Edvantage Program. The logos and other identifying marks attached are trademarks of and owned by each represented company and/or its affiliates. Please visit the website for each company offering a gift card (including an e-gift card) for additional terms and conditions.

It is the sole responsibility of any attendee to notify OTIP’s marketing department of any changes to their contact information by emailing us at marketing@edvantage.ca or calling 1-800-267-6847. Alternatively, in writing at OTIP c/o Marketing Dept., P.O. Box 218, 125 Northfield Drive West, Waterloo, ON N2J 3Z9, if they still wish to be entered into the Contest.

Entries and the prize claim are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered, or tampered with in any way.

General Conditions
This Contest is subject to all applicable federal, provincial, territorial, and municipal laws and regulations, is void where prohibited by law, and is governed by Canadian laws and the laws of the Province of Ontario. If any provision of these rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.

By participating in this contest, attendees agree to be bound by these rules and regulations and the rules and regulations set out by the provider of the Prizes, OTIP/Edvantage, and the company/companies offering the e-gift and Prizes.

OTIP/Edvantage will not be held responsible for any errors or negligence that may arise or occur in connection with the contest including, but not limited to, the attendee’s information entered into the contest RSVP page and the event page by any person , including, but not limited to, an Edvantage or participating partner’s customer sales representative.

All entries become the property of OTIP upon receipt and will not be returned. By entering this contest, attendees agree to the use of their personal information by the Privacy Policy regulating OTIP and Edvantage at http://www.otip.com/privacy (for OTIP companies). When attendees participate in a contest OTIP may keep a record of the information, response, or any opinion volunteered without reference to their identity to calculate the contest results on their respective websites or in other media such as business documents or leaflets sent to members. Collection of information, including name, phone number(s), and email address under this contest is strictly to administer this contest and provide any materials or information requested by the attendee. OTIP will use the personal information the attendee submits to contact an attendee and award a prize in the contest should the attendee be selected as a winner. By entering the contest, attendees who win any of the prizes, agree to have their names published; however, the identities of contest winners and other personal information are never published without their written consent. Consent will not be unreasonably withheld. If the attendee requests marketing information about OTIP products and services, OTIP may send the marketing information to the attendee’s email address, residential address, or as otherwise directed by the attendee. Personal information will not be shared with outside parties, save and except Edvantage participating partners, and only to deliver the e-gift and/or Prize.

All Prizes and e-gifts are non-transferable, non-assignable, and non-exchangeable for cash or any other form except at the discretion of OTIP.

The winners are responsible for ensuring they read and understand any rules, regulations, and terms and conditions of each company issuing the gift cards and products. OTIP and Edvantage are not responsible for any failure to read and understand these rules, regulations, and terms and conditions. Any taxes on any Prizes awarded, including income taxes, and any incidental expenses associated with the collection of the prize, are the sole responsibility of the winner. No substitutions will be made for any Prize except at the discretion of OTIP/Edvantage who may substitute a Prize of equal or greater value or substitute a provider of the Prize in the event any of the contest Prizes are no longer available. All Internet fees, transactional fees, down-loading fees, up-loading fees, accessories, application fees, Wi-Fi costs, roaming charges, costs of programs, long-distance charges, travel expenses, mileage, accommodations, meals, and extraordinary expenses, including but not limited to beverages and any feature and accessory not expressly listed as part of any prize shall be the sole financial responsibility of the prize winner. None of the attendees and/or the prize winners will be eligible to seek reimbursement for the same from OTIP, Edvantage, and their affiliates or representatives or any other party to this contest, including the companies offering any Prizes.

A Prize shall be null and void if the winner of a specific Prize does not accept their Prize by December 1, 2023. All Prizes may be subject to expiry dates set by the companies offering the gift cards and/or the company offering the Prizes and the winner of any Prize in this Contest must agree to abide by those rules, regulations, restrictions, terms and conditions, and expiry dates.

OTIP reserves the right to withdraw, terminate, suspend, cancel, amend or modify all or part of the contest, in any manner and any rule(s) of the contest, including the number of Prizes awarded, at any time and without prior notice, for any reason whatsoever or if it determines that for any reason the contest cannot be run as originally planned, including, but not limited to, technical failure or corruption, computer virus, bugs, computer, electronic or system malfunction, tampering, unauthorized intervention, fraud or any other factor(s) or cause(s) beyond OTIP’s control which in OTIP’s opinion compromises the fairness or integrity of the Contest and/or affects the administration, security, or proper conduct of this Contest as contemplated by these official rules. Failure to comply with OTIP/Edvantage and participating partner terms and conditions may disqualify the selected attendee and/or winner from receiving a Prize. Under this section, OTIP is not obligated to award any Prize to any selected attendee for any reason.

By submitting an RSVP to enter the event, the winner releases OTIP and Edvantage from any liability arising out of, or in connection with, this Contest and the awarding of any Prize, now or in the future. By entering this event, the winner consents in writing to the use of their name, city, and province where they reside by OTIP and/or Edvantage in a format approved by that winner, as well as any audio/video image, statements, and/or photographs in any related publicity and publication without further compensation, worldwide and in perpetuity, in any forms of media and social media now known or hereafter devised, including, but not limited to, the Internet, Facebook, Twitter, Linked In, YouTube, Pinterest, Snapchat and in any publicity or advertising carried out by OTIP and/or Edvantage, unless prohibited by law. OTIP reserves the right to post or publish any winner’s name, city, or province of residence, photograph, likeness, voice, or other statements, as directed by the winner, on its website and/or on the website of OTIP’s affiliated companies and/or on the sponsor’s website for advertising and promotional purposes, where lawful, without further compensation to the winner, worldwide and in perpetuity.

By entering the online event, the winner agrees to sign a form of declaration confirming compliance with the Contest rules and regulations and agrees to release, indemnify and forever discharge OTIP and Edvantage and their affiliated companies, directors, trustees, officers, employees, the Prize selection team and any of their parents, affiliates, agents, and contractors, the companies issuing the Prizes, and any advertising and promotional agencies whether for the Contest and/or the Prize, and all their directors, trustees, officers and employees, from any and all action, proceedings, suits, liability, losses, costs, expenses (including legal fees and disbursements), damages, demands and claims of any kind, in respect of anything done by OTIP, Edvantage and/or the companies issuing the Prizes in the performance of their duties hereunder in connection with the Contest and/or resulting from the acceptance, possession or use of a Prize or any part of a Prize or any extension to a Prize, including without limitation, but not limiting to, any loss, personal injury, death, disablement, dismemberment, property, home or auto damage, or claims based on publicity rights, defamation or invasion of privacy that could result from, but not limited to, the awarding or use of any Prize, by signing an Agreement / Release Form as a condition to and in advance of receiving their Prize in favour of OTIP/Edvantage and the Prize sponsor and neither OTIP, Edvantage or the companies issuing the Prizes will be liable for the use or misuse of the Prize. OTIP/Edvantage assumes no responsibility for the participation in the Contest or any liability, claims, demands, actions, loss, damage, or personal injury that may be sustained by the attendees and/or the winners. The provisions of this section shall survive the termination of this Contest and may be relied upon by the parties hereto at any time.

Failure to comply with these Contest rules and regulations may result in disqualification from the Contest at any time.

OTIP/Edvantage is not responsible for any theft, destruction or unauthorized access to, or alteration of, entries; failures or malfunctions of electronic data transmission, telephones, telephone lines or telephone systems, interrupted or unavailable network, server or other connections, any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to the participant’s or any other person’s computer related to or resulting from participation in this Contest; the cancellation, suspension or preemption of games, injuries or timing errors, electronic or equipment failure or other communication problems occurring in connection with participation in this Contest nor is it responsible for any transmission of viruses from any OTIP website and Edvantage website to a computer system or if any whole entry system crashes resulting in the Contest being cancelled or other problems or errors of any kind whether mechanical, human, electronic or otherwise.

OTIP, Edvantage, the prize selection team and the companies offering the Prizes and any of their parents, affiliates, agents, and contractors, including advertising, sponsoring and promotional agencies, and their directors, trustees, officers and employees expressly disclaim and shall be held free of all responsibility or liability for any loss or damage in respect to any prize howsoever caused, any act, error, omission, injury, loss, accident, delay or the neglect or default of any company or person providing any service for the Contest giveaways whether through providers negligence or otherwise, or due to cancellations, adverse weather conditions, loss of personal belongings, illness, bodily injury, accident, death, deterioration of services, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical due to any Acts of God, force majeure or third party wrong doing, epidemic, social or political disturbances or due to any cause whatsoever occurring during the Contest and the use of the Prize by the winner.
